Rachel Dineley, Ceri Fuller and Khurram Shamsee of Beachcroft will be leading the masterclass, with Alan Beazley and Rachel Krys of the EFA/EFB.  We will start with an overview on legal developments, followed by a debate on some of the more challenging issues arising, to help you identify the key areas that should concern the Board of your organisation, including, in particular, the cost implications of the Act.

The session will cover:

  • Age related issues (particularly retirement and associated issues).
  • Developments in relation to religion and belief (the contrasting cases of Eweida v British Airways on the one hand and Grainger Plc v Nicholson on the other).
  • Overview of the Equality Act: key issues for employers to consider in the light of the Equality Act as they particularly relate to age and religion or belief. We will focus on:

o The protected characteristics and the scope of protection in relation to, in particular, age and religion or belief.

o The implications of the provision relating to claims where "dual characteristics" are involved. We anticipate that age and disability could be combined quite often.

o Disability provisions (and the reversal of the Malcolm v Lewisham case law) and the scope of the duty to make reasonable adjustments.

o Proposals in relation to the extension of protection in relation to age in the provision of goods, facilities and services.

o To the extent that time permits, the impact of public sector equality duties and requirements on procurement.
