Employers Angry That Retirement Laws May Leave Them Open To Discrimination Claims

All employers retiring people at 65 could face unlimited liability for claims pending an ECJ decision on 'Heyday', not expected before 2009. This could mean thousands of claims building up in the Tribunal system, with employers in the dark as to whether they have acted lawfully.

Rachel Krys, Director of the Employers Forum on Age comments: "Employers are extremely angry that the retirement process, which was introduced last year as part of the age discrimination regulations, exposes them to this unacceptable risk.

"Employers who are using the retirement process need a cast iron guarantee that if they are following the law to the letter, they are protected. The goodwill of employers towards this legislation is being stretched to breaking point.

"The Government needs to show leadership and reassure employers that the laws created last year are robust and have not led employers into an expensive dead-end."
